Do you have to ask people for their permission in order to use their picture that you took in your portfolio?

It will save you a lot of hassle if someone takes offense. All the model releases include a paragraph that allows both the photographer (me) and the model to use the images for self-promotion.

Since most "books" are now placed on the Internet, the chances of one of your subjects seeing themselves in your portfolio have increased.

So, in the strictest sense, you do need permission.

    I wouldn’t. You took the picture so the rights of it do belong to you. Especially if you’re using the portfolio for work related things, then I wouldn’t ask.

    I would suggest you include a "model release" in your contract with the client. You do have a contract don’t you? Pro photography is a business. If you treat it like one then there are certain things you must get into place before taking a job. The desire to use an image to promote your work is pretty basic. With a model release you cut the possibility of certain legal actions being taken against you. What you think is a great photo and how a client views the image can be entirely different. Cover your bases…it makes sleeping at night much more pleasant.

    If you are taking a photo and going to use it to show just your work to others is no big deal. If you are going to make money selling those photos, You need a proper model release. You might get a release just to SHOW your work and elliminate any gold digger from trying to get money out of you.
